Trainee License Agreement

Thank you for your interest in the ICM training and Software Access.  To allow access and use of this Software, please review the terms and conditions outlined in this User Agreement and indicate your acceptance of the same by clicking “I Accept” at the end of this Agreement.

  1. The Case Management Society of America (CMSA) is the owner of the ICM Training materials, training program, and ICM-CAG (collectively “Software”).  As such, CMSA owns the copyright and all proprietary rights to the training materials and Software. CMSA’s rights are protected by U.S. and international intellectual property laws. Accordingly, you agree that you will not copy, reproduce, alter, modify, or create derivative works from the training, training materials, or Software.
  2. CMSA grants to you a personal, non-assignable, non-exclusive, license for temporary use of the Software during your training session, subject to these terms and conditions.
  3. In order to access and use the Software, CMSA must first establish a username for you. To secure a user name, you must contact CMSA directly.
  4. To access and use the Software, you must participate in Software training provided by CMSA.  You agree to use the Software in accordance with instructions provided in the Software training.
  5. You may only enter data and edit existing data in the Software if you have been granted such permissions by CMSA. You are strictly prohibited from entering any live patient/client/individual information.
  6. CMSA may suspend or terminate this Software license or may suspend or terminate your use of the Software if you fail to comply with the terms and conditions of this Agreement. Suspension or termination may delete your information files and previous content. CMSA may temporarily suspend access to the ICM-CAG at any time for maintenance or defect repair.  Thus, there is no guarantee of 24 hour, 7 days a week access to the Software.

You may not reverse engineer this Software or make copies, lend, or lease access to this Software.  Neither can you provide your personal username or access tokens to another user for their use.  Allowing others to use your ICM-CAG credentials may result in termination of access to the software.

You agree to hold harmless, indemnify and defend CMSA, Fraser Imagineers, their respective officers, agents, and employees from and against any third-party claim arising from or in any way related to your use of the Software including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. The terms of this provision shall survive the termination or expiration of your use of the Software.
